Please read these Terms of Service ("Terms") carefully before using MyCertainKey ("the App"). By using the App, you agree to be bound by these Terms.

## 1. Acceptance of Terms

By downloading, installing, or using MyCertainKey, you agree to these Terms of Service. If you do not agree, do not use the App.

## 2. Description of Service

MyCertainKey is an iOS application that allows you to:
- Create custom NFC-powered checklists

## 3. Eligibility

- You must be at least 13 years old to use this App
- You must have a compatible iOS device (iPhone 7 or later)
- You must have iOS 18.0+
- You must have NFC capability on your device

## 4. Free vs. Premium Features

### Free Tier
- 2 week trail

### Premium Tier (Subscription Required)
- Unlimited tag creation
- Advanced features (as they become available)
- Priority support
- Early access to new features

## 5. Subscriptions

### Auto-Renewal
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You will be charged through your Apple ID account

### Cancellation
- You can cancel your subscription at any time through your Apple ID account settings
- Cancellation takes effect at the end of the current billing period
- No refunds for unused portions of subscription periods

### Refunds
- Refunds are handled entirely by Apple
- Contact Apple Support for refund requests
- We do not process refunds directly

## 6. Your Responsibilities

### NFC Tags
- You are responsible for purchasing compatible NFC tags (NTAG213, NTAG215, or NTAG216)
- You are responsible for the physical security of your NFC tags
- We are not liable for any loss or damage to your NFC tags

### Device and Data
- You are responsible for maintaining the security of your iOS device
- You are responsible for backing up your data (we recommend using iOS backups)
- We are not responsible for data loss due to device damage, loss, or software updates

### Use of the App
- Use the App only for lawful purposes
- Do not attempt to reverse engineer or modify the App
- Do not use the App to violate any laws or regulations

## 7. Data Storage and Privacy

- **Local Storage Only**: All data is stored exclusively on your device
- **No Cloud Sync**: We do not sync, store, or transmit your data to any servers
- **No Data Collection**: We do not collect any personal information
- **Your Data, Your Device**: All checklists, tags, and history remain on your device only

## 8. Limitation of Liability

### No Warranties
- The App is provided "as is" without warranties of any kind
- We do not guarantee the App will be error-free or uninterrupted

### Liability Limits
- We are not liable for any indirect, incidental, or consequential damages
- We are not liable for data loss or device damage

### Service Availability
- We do not guarantee continuous, uninterrupted access to the App
- The App may be unavailable due to maintenance, updates, or technical issues

## 9. Intellectual Property

- The App and all content are owned by us or our licensors
- You may not copy, modify, or distribute the App without permission
- All trademarks and logos are property of their respective owners

## 10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted with an updated "Last Updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

## 11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including:
- Violation of these Terms
- Fraudulent or illegal activity
- Harmful behavior

You may stop using the App at any time by uninstalling it from your device.

## 12. Third-Party Services

### Apple Services
- The App uses Apple's App Store, StoreKit, and other Apple services

## 13. Governing Law

These Terms are governed by the laws of New York State. Any disputes will be resolved in the courts of New York State.
